Surrogacy in Czech Republic: How cross-norder programs work (2026)

Surrogacy in the Czech Republic with No Legal Barriers.

The Czech Republic is the perfect destination to avoid single men or gay couples having to travel outside Europe for a surrogacy process. The fertility process is performed in Cyprus with a Ukrainian surrogate. Pregnancy monitoring takes place in Ukraine, and the birth happens in Prague. That is why the Czech Republic is a viable option for surrogacy.

Legal Framework

What is cross-border surrogacy in the Czech Republic?

In the Czech Republic, surrogacy is not regulated but it is permitted, which means there are no legal limitations of any kind to carry out a process in this country. Starting from this base, a completely safe protocol has been developed in collaboration with several fertility clinics abroad, combined with a surrogacy contract with a Ukrainian surrogate. This protocol is called “Cross-Border Surrogacy”.

A safe, regulated protocol built across borders.

Cross-Border Surrogacy is the secure protocol that allows intended parents to benefit from a fully safe journey with a Ukrainian surrogate, ending with a birth in Prague. The program is designed to be legally robust at every step.

No Legal Limitations

Surrogacy is not regulated in the Czech Republic but it is fully permitted — no restrictions apply.

The Process

How Cross-Border Surrogacy Works

The Cross-Border Surrogacy protocol unfolds through four carefully orchestrated stages across three countries. It is designed for safety, legal clarity, and maximum comfort for intended parents who don't meet the requirements of a single-country program.

01

IVF in Cyprus

Cyprus has excellent fertility clinics and a legislation that allows fertility treatments with egg donation to any patient type. The male intended parent must provide his genetic material.
02

Embryo Transfer to Ukrainian Surrogate

Intended parents sign a notarial power of attorney with our coordinator to sign the surrogacy contract on their behalf. The Ukrainian surrogate travels to Cyprus for the embryo transfer and waits for the pregnancy test result. If pregnancy is not achieved, another transfer is performed or the surrogate is changed.
03

Confirmed Pregnancy & Monitoring

The surrogate returns to Ukraine — to her home — where the largest part of the pregnancy takes place. Our agency conducts strict pregnancy monitoring in one of our selected clinics based on proximity and quality.
04

Birth in Prague

At the seventh month, the surrogate travels to Prague to prepare for delivery, with the last part of the monitoring taking place in the Czech Republic. Approximately 7 days before the birth, the surrogate is admitted to the maternity hospital to await delivery.

Why the Surrogate Is Ukrainian

Patients who wish to pursue surrogacy in Ukraine must meet a series of requirements, but Ukrainian legislation allows all those parents who do not meet these requirements to carry out a process with Ukrainian citizens, provided the process is developed outside Ukraine.

The contracts signed with a Ukrainian citizen are completely valid, with the rights and obligations of both parties being enforced.

Why This Matters for You

Cross-Border Surrogacy opens the door to single men, gay couples, and heterosexual couples who don’t meet Ukraine’s stricter requirements — combining the safety of a Ukrainian surrogate with the comfort of a European birth in Prague.

Workaround for Ukraine's restrictions

Open to parents who don't qualify for in-country Ukrainian programs.

European birth experience

High-quality hospitals in Prague for the final stage.

Fully valid contracts

Rights and obligations enforced for all parties.
Eligibility

Who is eligible for Czech Republic cross-border surrogacy?

The Czech Republic offers one of the most flexible access windows in Europe. Heterosexual couples, single men, and gay couples are all welcome — without the stricter requirements of other destinations. There is no need for an infertility report for the woman.

Who Is Eligible

Open Family Types

All heterosexual couples, single men, and gay couples can pursue surrogacy in the Czech Republic — with no need for a medical infertility report.

Heterosexual Couples

Married or unmarried — both options accepted with no limitations. No medical infertility report is required for the woman.

Single Men

Fully eligible. Single men can pursue a Cross-Border Surrogacy program without restrictions.

Same-Sex Male Couples

Gay couples (married or unmarried) are fully accepted. A key differentiator vs. more restrictive destinations.
Who Is Excluded

Single Women & Lesbian Couples

Single women and lesbian couples cannot pursue a process in the Czech Republic. For these cases, the recommendation is to apply to Mexico or Colombia, which fully accept them.

Single Women

Not eligible for Cross-Border Surrogacy in the Czech Republic. The protocol is built around a Ukrainian surrogate and a male genetic contribution.

Lesbian Couples

Not eligible. Same-sex female couples are redirected to Mexico or Colombia for programs designed for them.
Surrogate Criteria

Requirements for a Surrogate in the Czech Republic

Since programs developed in the Czech Republic are carried out in collaboration with a Ukrainian woman, the requirements of Ukraine are those a surrogate of this program must meet.

1

Age: 18 to 36 Years

The woman must be within the legal age range to safely carry a pregnancy.
2

At Least One Healthy Child

The surrogate must have been a mother of at least one healthy child, demonstrating proven gestational capacity.
3

Rh+ Blood Factor

The surrogate must have an Rh+ factor to avoid possible incompatibilities during pregnancy.
4

Physical & Psychological Health

She must be physically and psychologically prepared to carry a healthy pregnancy to term.
Why the Czech Republic

Why choose the Czech Republic: EU citizenship for the baby

These are the reasons intended parents consistently mention when they tell us why they chose Cross-Border Surrogacy in the Czech Republic with One Surrogacy — combining European quality with flexible access.

Open to Single Men & Gay Couples

A rare combination in Europe — Cross-Border Surrogacy welcomes family types excluded by stricter programs in Ukraine and Georgia.

No Infertility Report

For heterosexual couples, no medical infertility report is required for the woman to qualify — making access simpler.

European Birth in Prague

The final stage takes place in Czech hospitals, offering European standards of care, infrastructure, and comfort.

Valid Ukrainian Contracts

Surrogacy contracts signed with a Ukrainian citizen are fully valid and enforceable, with rights and obligations respected.
